The Cordilleras might put to test the effectiveness of the Writ of Kalikasan if the local government of Itogon decides to pursue filing of a petition against LGTM Corporation, a subdivision developer in Kias barangay.
Following the city council’s recall of LGTM’s development permit, Councilor Betty Lourdes Tabanda suggested for Itogon officials to file the writ as another remedy that they could avail themselves of to enjoin the developer from proceeding with some of its activities that have polluted the Ambalanga River.
In a telephone interview, Itogon Mayor Oscar Camantiles said he is considering Tabanda’s advice. He said he, the municipal legal officer, and the municipal council are already discussing the matter.
Issued last year by the Supreme Court, the Writ of Kalikasan is one of the six provisions that could be availed of in environmental cases. The provision allows ordinary citizens the right to a better environment.
A petition for the issuance of a Writ of Kalikasan entails for the court to issue an environmental protection order that would either “direct or enjoin any person or government agency to perform or desist from performing an act in order to protect, preserve or rehabilitate the environment.”
The SC, in its website said the issuance of a Writ of Kalikasan, similar to the writs of Habeas Corpus, Amparo, and Habeas Data, is immediate in nature.
In 2010, Camantiles asked Mayor Mauricio Domogan to look into LGTM’s violation of its environmental compliance certificate.
The developer of St. Bernice Homes Housing Subdivision Project in Kias under LGTM Corp. was ordered by the Environment Management Bureau to pay the amount of P85,000 for violating its ECC conditions.
It was also issued a cease and desist order.
LGTM’s earth moving activities blocked the flow of the Ambalanga River, which traverses the entire municipality of Itogon.
